We do not represent either party and are not directly involved in any transactions between customers and businesses. HappyQ does not guarantee the services of the businesses nor does it provide any guarantees as to the authenticity and financial viability of the customers and job posts.
  15. HappyQ will not be liable under any circumstances for any loss of profits or any damages of any kind recognised by law (even if it has been advised of the possibility of such loss of profits or damages).
  16. You understand that HappyQ does not hold any liability to the Customer and will not personally refund them any payments made in the use of Services from Businesses on our Website.
  17. HappyQ is not held liable if a Professional communicates false information. It is the Customer's duty to check all their requirements with the Professional directly, this includes checking Professional's qualification and any insurance.
  18. Notwithstanding the above clause, if a Customer is unsatisfied with the services provided by a Business or believes that they may be entitled to a refund, then HappyQ requires the Customer to:
    1. Contact the Business directly to request a refund; and
    2. The customer can contact HappyQ outlining why you believe you are entitled to a refund and we will try to mediate the situation. We can also determine if the Business should be removed from the HappyQ Website.
  19. The Website, the Services and all of the related products of HappyQ are subject to copyright. The material on the Website is protected by copyright under the laws of the U.S. and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by HappyQ or its contributors.

  21. HappyQ does not grant you any other rights whatsoever in relation to the Website or the Services. All other rights are expressly reserved by HappyQ.

HappyQ will remove any material and/ or information, including but not limited to links to Businesses, at any time without giving any explanation or justification for removing the material and/or information.
  32. You will not use the Website or HappyQ services in connection with any commercial endeavors except those that are specifically endorsed or approved by the management of HappyQ.
  33. You will not use the Services or Website for any illegal and/or unauthorized use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website;
  34. These terms and conditions may be amended from time to time. Your continued use of our Website following any such amendments will be deemed to be confirmation that you accept those amendments.
  35. You indemnify us from and against all claims, suits, demands, actions, liabilities, costs and expenses (including legal costs and expenses on a full indemnity basis) resulting from your use of the Website.

  39. HappyQ may at any time, terminate the Terms with you if:

    2. HappyQ is required to do so by law;
    3. HappyQ is transitioning to no longer providing the Services to Members in the country in which you are resident or from which you use the service; or d. the provision of the Services to you by HappyQ is, in the opinion of HappyQ , no longer commercially viable.

    Subject to local applicable laws, HappyQ reserves the right to discontinue or cancel your access to the Website at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts HappyQ's name or reputation or violates the rights of those of another party.

  41. Free Trials and Other Promotions. Any free trial or other promotion that provides access to a Paid Service must be used within the specified time of the trial.
